Two people with mental health problems, who claimed the test for sickness benefit would discriminate against them, have won their legal challenge.

Judges ruled the Work Capability Assessment puts people with mental illness, autism and learning difficulties at a substantial disadvantage.

The process is too difficult for many to navigate, a court heard.

The Department for Work and Pensions says it will appeal against the ruling.

Work Capability Assessment (WCA) tests, which measure a person's entitlement to Employment and Support Allowance (ESA) by determining whether they are fit for work, were introduced in 2008 and are carried out on behalf of the government.

The law requires the government to make reasonable adjustments to avoid discrimination.

'Significant improvements'

The Upper Tribunal was told people who have conditions that mean they lack insight can struggle to gather the right documents needed for a successful claim, such as doctors' reports.

The judgment is a victory, not only for the two individuals involved in this case, but for thousands of people who have experienced additional distress and anxiety”
End Quote
Paul Farmer

Mind
The judgment was the result of a judicial review brought by two claimants with mental health problems, whose identities have been protected.

Lawyers for the two argued that where a claim is from someone with a mental health problem, it should be the government's responsibility to seek additional medical evidence.

UK charities Rethink Mental Illness, Mind and the National Autistic Society intervened in the case to provide evidence based on the experiences of their members and supporters.

Almost 20,000 people are assessed each week for ESA - including those moving over from the old benefit system of Incapacity Benefit (IB) - in England, Wales and Scotland, DWP figures show. The benefits system in Northern Ireland is administered separately.

More than a third of these people are claiming primarily for mental health problems, meaning tens of thousands of people each month are going through a process that puts them at a substantial disadvantage, the mental health charity said.

Under the current system, evidence from a professional, such as a GP or social worker, is expected to be provided by claimants themselves. There is no obligation for the DWP to collect this evidence, even on behalf of the most vulnerable claimants - apart from in some rare cases.

The charities involved in the case called on the government to suspend use of WCA tests for the people they help.

Mind's chief executive Paul Farmer said: "The judgment is a victory, not only for the two individuals involved in this case, but for thousands of people who have experienced additional distress and anxiety because they have struggled through an assessment process which does not adequately consider the needs of people with mental health problems."

The DWP said it wished to work with charities to "continually improve" the WCA for people with mental health problems.

But a spokesperson said: "We disagree with today's ruling and intend to appeal.

"We believe we have made - and continue to make - significant improvements to the WCA process for people with mental health conditions. The percentage of people with mental health conditions who go into the support group for ESA has more than tripled since 2010."

Hi guys,
Just after a bit of advice.
Looking to go to Silverstone for Moto GP this year and perhaps some of you may been the previous years so are aware of which packages/tickets are best for getting an opportunity to meet the riders.

Obviously I want to get up close to the riders, take some photos and exchange a few words allowing the circumstances. For this I understand you would need a paddock pass.
There are a few options available: cheapest one being the Riders for Health Day on 29th August. Anyone been? What are the chances of meeting the current MotoGP riders?
The other options are a Team Experience with Honda Gresini (either on Sat or Sun/both) with unlimited paddock pass and 1 pit lane walk or lastly the VIP VILLAGE with 30 mins paddock tour and 1 pit lane walk when race not on.

All advice welcome :)

Delightfully I've been given the task of creating and maintaining my departments area of the intranet, which involved 30 minutes of being shown the very basics on Sharepoint and then pretty much being left to my own devices.

I am making my way through some "instructional" videos (they are sooooo interesting) but am yet to find the one that will explain this and I am rapidly getting bored watching them.

On pic 1 it shows a list I have imported from Excel. Second column shows the "type" - I want to edit/change some of those as they seem to affect which columns I can filter. Only problem is that not all of them give me the option to change the type (see pic 2), which is what I want to change (I think).

Anyone know a. why? and b. how do I resolve this?
It's not quite the start I had in mind for a 3 year old readership, although it has an undeniable grab factor. I know I was trying to avoid the inanity of Blighton's Milly Molly Mandy, but..

So over to you lot as I'm sure you can do better. Because I can see it currently panning out to her taking her Uzi 9mm wand from under her left wing & expelliarmusing the lot of them, whilst uploading the live video feed with her iBeak. Which will make for a far shorter book than I had planned & Disney might have some trouble with the film.

Looking for some advice on the legalities / practicalities of towing a home-built trailer in Spain. General advice on driving in Spain is pretty easy to come by but all I can find about towing a trailer in Spain seems to be geared towards ex-pats who want to repatriate their UK-bought trailers to Spain and tow them with a Spanish-registered car.

Basic'ly, we're taking the MX5 to Mundaka for a fortnight. We had planned to use the awesome Boot Bag that I bought last year to get all our stuff in, but last week the missus randomly purchased a half-Mini trailer. It's a good solid bit of kit with all working lights and reflectors, and would at least double our carrying capacity. I'm considering taking it if I can get a tow bar for the '5 and if the ferry won't rape us for the privelage of taking a small trailer on board.

Because it's home made I have no idea what the maximum carry weight would be, but wouldn't expect it to exceed 750Kg. It's made out of the back end of a Mini.

Anyone have any advice, or can point me in the right direction?

We're going direct to Santander so no worries about driving through Franceland.

Thanks all.

Not sure there is anything that screams 'buy me' over the PS, but I will wait until both are released before making a choice. I have a feeling that most people will just stick to what they play on now, either Sony or Xbox.
