DVLA fine for not returning V5 after sale

Sixty five quid they want. I did fill in the V5 and return it. About 6 weeks later they sent me a letter saying someone ...

    Sixty five quid they want.

    I did fill in the V5 and return it. About 6 weeks later they sent me a letter saying someone wanted to register the car and had I sold it and I said yes, signed it and sent that back too.

    Now they're trying to fine me for not informing them that I sold the vehicle.

    Fuckers. They can stick it up their arse for nothing and fuck off while they're at it.

    A couple of years ago I got in a tussle with DVLA over my driving licence. Some help from one of our plod on TRC and my local MP finally sorted it. Use the resources available to you cos they won't admit their wrong until forced to.

    I had the same problem two years ago. Think i ended up with three letter with the last telling me i am going to court. See you in court then was all my reply was and never heard a thing since. The letters came from the Glasgow office. I dont think they talk to Swansea as i did ask for proof that i did not send it after them asking for proof i did.

    this article might be worth a read..BBC - Watchdog: DVLA in the dock

    a biker went to court over a fine for SORN and won because he had no responsibility to chase up the DVLA once the paperwork is in the post.

    I had exactly the same, I phoned them up and they said no problem and waived the fine. Have you bothered to contact them?

    Same happened to me a couple of years ago, I bottled it and paid the 30 they claimed I had to as I had not kept the letter they had sent me about the logbook after I had sold a car.

    I know I had sent it off, know it was changed, and I know I chucked the confirmation letter it out. But 8 months on they demanded compensation when the new owner taxed the car again as they did not have a record of the new owner. Paying the 30 was easier than arguing with the fuckwits at the time. I would not do that again.

    That's why EVERY transaction with DVLA needs to be copied, scanned and sent by Recorded Delivery. The are incompetent buffoons who cover their failures with fines.

    I forgot to send the green slip off when my mate bought a bike off me, and this generated a fine.

    I ignored it.

    End of story really!

    Aye, when I sent off my photocard for renewal (well I actually did it at the PO and they cut it up in front of me) I had colour scans of both bits, both sides - which I filed with the receipt. Anything Ive had to send them in the last few years Ive copied beforehand due to having a 35 fine sent to the previous owner of a bike (which I agreed to pay) after he left me to post both bits, which I did in the same envelope and received a V5, so they deffo had both bits, but you cant argue with these cuddly wuddly beary beary boos.

    Some years ago after my bike had been off of the road and the SORN overloooked I got a fine, so contacted my local DVLA ofice and "explained" I had been out of the country for a year. Fine rescinded and letter confiming as much on my doorstep in a couple of days.. :-x
    If you have a local office you can deal with, always go for them - spoken to them a few times and always been pretty helpful / seem like human beings you can actually communicate with

    We should bookmark such items for future reference , do we have a legal advice forum on the T.R.C ? if not why no

    Oh and wots a v5 is that a new motor ? how would you vee a 5 cylinder is it 3 n 2

    I think the guy who first went to court over it is called "sickpup" at www.bikechatforums.com . If you do a search there, there are a number of threads about how to approach it in court, what the appropriate case law is etc. He seems to have helped a few people there to do the same thing and I get the impression the circumstances and law surrounding all of this have become a bit of a hobby for him now. Might be worth digging out a few of his threads or dropping him a line for a few pointers.

    There's a case on that forum where some 19 year old kid was taken to court after refusing to pay, turned up on his own without any legal support (but a pack of information ready to present to the court - most of which he'd taken from threads at bikechatforums). Court security guy asks him why he's on his own and he explains what he's doing. Security guy goes and tells the DVLA lawyer who then comes over to him asking what he's up to. He tells/shows her what he's about to present to the court. Case withdrawn before it even enters the court and he's told he can just go home. I'm not sure if that was over sorn or a V5 though or whether that would make any difference (I'd guess it wouldn't as the principal would be the same).

    Perhaps just telling the DVLA what you're planning to do should it get to court might be enough to stop them threatening you with court and force them to write off the 'fine' (I'm not sure it really is a fine)? Don't know if anyone has tried that yet or if it would deter them.
