    Default Employer problem regarding double time

    Hello basically I work for a security firm and I had to work Xmas day and boxing day, both these days I was paid double time, however yesterday I've come down with a flu/cold and got barely any sleep and had to work a 12 night shift, when I went to call in sick (which I've never done before while working for this company) I was told that if you call in sick two weeks before or two weeks after double time then they won't pay the extra money, is this legal?

    I am not a lawyer.

    It might depend what your contract says.

    But (a) I've never heard of pay for given days being conditional on behaviour on other days, and (b) I've never heard of ways of managing ( suspected lies about ) being ill including this. Normally they would have establish an excessive sick leave pattern - but every employer can have their own process. At an industrial tribunal etc ( which is really only for if you lose the job or are effectively forced out ) the issue would be whether they always followed the same procedure. Is it in writing anywhere - eg a staff website/ intranet

    Check your contract but unless it says it explicitly then no it is no legal. Pop along and see a gp so you have evidence you are genuinely ill in case you need it but tell them that this is nonsense. You in a union? If not join one pdq I am guessing you work for a Carlisle group company so a union would be a good idea
