    After 45-year-old Miss Lindsay complained, an employment tribunal described Mr McAleese’s use of the words ‘golliwog’ and ‘golliwog jam’ as ‘unwanted’ and ruled that what he said amounted to ‘an isolated act of harassment’.

    That was despite the fact that Mr McAleese had swiftly apologised to his co-worker after the incident in January 2009 and said he had not intended to violate Miss Lindsay’s dignity or to ‘create an intimidating, hostile, degrading or offensive environment for her’.

    Three Appeal Court judges today upheld the tribunal’s harassment finding, even though Mr McAleese had spoken with his back turned, in a quiet voice and his comments were not aimed at Miss Lindsay, of Clapham, south London.

    Which is implying he called her a gollywog and then pretended it was an innocent mistake.

    Is it fuck. That’s a hell of an assumption he making on behalf of ALL black people. And if I had a conversation with a black person in the context of discussing the Golliwog image as a tool of oppression and it’s history, that’s not ‘offensive’. It’s called using a word. Once again, the principle of the context a word is used in seems to have been ignored here.

    I could say the work Nigger. And I have done, in a discussion about the word with someone I knew who was (and still is as far as I know) black. He didn’t get offended and he didn't misconstrue the use in the context. I didn't use it as a tool to offend or insult and neither was this. Probably.

    Mind you, we don't have a transcript of the offending conversations. He might have said 'Gollywog jam tastes of slaves' or something.

    We were at a pub quiz a while back, its normally quite good fun since the quiz master always has some good alternative rounds rather than just the predictable ones, one is a movie round which involves knowing the movie. You get marks for the funniest wrong answer also which is always good when those answers are read out. Imagine the scene some yoghurt weavers caused when question 4 in the The Dambusters Movie round was "what was the name of Guy Gibson's Dog".

    And now imagine the look on my face and what I told them when they came over to tell me that they had complained and hoped I wasnt offended. FFS

    Stop being horrible. Or risking sounding like you are. And if it happens, by genuine mistake, then apologise.

    You get a chance to enter a plea before a court hearing. So act like an adult human being at that point too ...

    Even if that's true, to end up in a court of law for one racist remark. A court of law for one count of name calling. Seriously he said golliwog which she over heard and he apologised for and 5 months later she complains and it gets to a court of law with barristers and everything. FFS!

    FWIW, I've worked at the LSE and no one there would be under any misapprehension about how the LSE would deal with racism, so I actually doubt he would have said it in a directly offensive manner.

    Being directly offensive in that way is illegal.

    And rightly so, to promote social unity and wellbeing. In the long run.

    Internal discipline procedure, its what its there for. This was not an onslaught of racial abuse. It was an overheard remark whose direction or intention is ambiguous at best. It should not have reached a court of law.
