Default Section 5: Govt admits defeat

Latest news is that Theresa May has accepted the Lords amendment to Section 5 of the Public Order Act. Details of the amendment and links to the bizarre alliance of opponents here Victory in the House of Lords | Reform Section 5

Thank goodness. There weren't many cases, but it seemed to be building a head of steam that was deeply inimical to free speech.

I now know what 250 is but still don't know what section 5 is, I'm guessing it was illegal to insult people but now it isn't.

It will be interesting to see how this plays out, although I agree in theory. Difference between abusive and insulting is pretty narrow anyway?

In one aspect some of TRC, a small some, should be relieved. They can't be charged with insulting our intelligence.

I agree that there is a category of speech that is on the border between the two, but there are huge areas of discourse where insults are routinely traded without abuse. Politics is full of insult. Arguably, every sarcastic remark is an insult.

Plus there's another dodgy borderline, that between insult and offence. Most of the notorious cases quoted by the RS5 lobby weren't insulting, in that there was no mens rea. Quite simply, somebody took offence at what somebody else had said or written, and claimed to have been "insulted".
