So from that you may be able to tell how bad the fault was considered and when it was reported.

    Boing

    Time for an update methinks

After much to and fro with Highways England last December i received their initial "Its nothing to do with us and there wasnt a fixable issue we found on inspection" letter. In response to this i sent in a lengthy report on exactly where they failed in their duty to road users and used their own defence clauses against them by proving they, or their inspection procedures were flawed.

I have sent in medical evidence and more photos of the pothole over a period of months they still havent fixed and finally they have agreed to pay out compensation to me in respect of the incident. This will cover my injuries, all my damaged kit and my excess. Legally they wont admit liability so the accident remains on my file for the next few years but nothing i can do about that.

Its not a massive amount but when i submitted the claim i had a figure in my head i would have been happy with as it would effectively have paid for the replacement Multistrada and all my kit.

After some haggling i got that figure so there might just be enough left for a "beers on me" shout

Thanks to 636mick and Horse for their pointers along the way

    Good work!

    But is the pothole fixed?
(can't remember if you've mentioned that earlier in the thread)

Yeah!! Good on ya well done for sticking to your guns. Know how it feels had the same fight with my off in 2012. No one would listen or give a shit but becoming an itch they cant scratch eventually gets results. Jolly well done👍👍

Its been poorly patched a few times over the year but that entire stretch is currently subject to night time closures and lots of the troughs are being properly repaired
